Terms of Service

Note: This is a first-pass template drafted for the portal. Please have it reviewed by legal counsel before relying on it in production.
Welcome, and thanks for trusting Premier Paws Pet Care, LLC("Premier Paws", "we", "us") with your pet. These Terms of Service ("Terms") govern your use of our client portal at portal.premierpawspetcare.com(the "Portal") and any associated services booked through it. By creating an account or using the Portal, you agree to these Terms.
1. Who we are, what we do
Premier Paws provides pet-care services — including dog walking, drop-in visits, overnight care, and related services — in the Delaware area. The Portal is a tool for existing and prospective clients to request visits, review history, and communicate with us. We are not a veterinary practice. We do not provide medical advice or emergency medical care. For medical emergencies, call your veterinarian or an animal emergency hospital.
2. Your account
To use the Portal you must (a) be at least 18 years old, (b) provide accurate, current information about yourself and your pet(s), and (c) keep your login credentials confidential. You are responsible for everything that happens in your account. Notify us immediately at info@premierpawspetcare.com if you suspect unauthorized access.
3. Booking visits and acceptance
A visit request submitted through the Portal is a request, not a confirmed booking. Visits are only confirmed once our team marks the request "Approved" within the Portal (or otherwise notifies you). We reserve the right to decline any request at our discretion — for example if a pet's temperament poses safety risks, if scheduling is full, or if the service area is outside what we cover.
4. Cancellations and rescheduling
You may cancel or reschedule a pending or approved request from the Portal until the service window begins. Depending on timing, a cancellation fee may apply per our published cancellation policy, which we will communicate to you directly. Same-day cancellations and no-shows may be billed at full rate.
5. Home access and keys
If you provide keys, lockbox codes, smart-lock access, or any other means of entering your home for service, you represent that you are authorized to grant that access. We treat keys and access information with care, but we are not liable for acts of third parties (including other residents, maintenance workers, or visitors) who hold or obtain access independently of us. If you change locks, codes, or access means, update the Portal and notify us so we can continue service without interruption.
6. Pet information, health, and behavior
You agree to provide accurate information about your pet, including any medical conditions, allergies, medication schedules, and behavioral considerations (e.g. fearfulness, aggression, escape risk). We rely on this information to keep your pet — and our team — safe. Failure to disclose material information may result in declined service, additional fees for emergency care, or — in serious cases — termination of your account.
In the event your pet appears ill or injured, we will attempt to reach you first. If you cannot be reached and we determine veterinary care is warranted, we may transport your pet to your listed veterinarian or the nearest available veterinary facility. You are responsible for the cost of any such care. We recommend keeping your veterinary contact information up to date in the Portal.
7. Payment
Payment for services is handled outside of the Portal. Rates, invoicing, and payment methods are communicated directly. The Portal does not collect or store credit-card information. Unpaid invoices may result in suspension of future service.
8. Your content
You may upload photos, notes, and other information about your pet to the Portal. You retain ownership of anything you upload. By uploading, you grant us a limited, worldwide, royalty-free license to store, copy, and display that content as needed to operate the Portal and provide service. We will not publish your content outside the Portal without your consent.
9. Acceptable use
You agree not to:
- misuse the Portal (including probing, scanning, or testing for vulnerabilities without permission);
- upload content that is unlawful, defamatory, or that infringes someone else's rights;
- attempt to access another user's account or data;
- impersonate anyone or misrepresent your relationship to a pet or household;
- use the Portal in any way that violates applicable law.
10. Service availability
We do our best to keep the Portal running smoothly, but we do not guarantee uninterrupted availability. The Portal is provided "as is" and "as available". We may modify features, take parts of the Portal offline for maintenance, or discontinue the Portal entirely with reasonable notice.
11. Limitation of liability
To the maximum extent permitted by law, Premier Paws Pet Care, LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Portal. Our total liability to you for any and all claims arising out of the Portal will not exceed the amount you paid us for services during the three months preceding the event giving rise to the claim, or $100, whichever is greater. Nothing in these Terms limits liability that cannot be limited by law (such as liability for gross negligence or willful misconduct).
12. Indemnification
You agree to defend and hold Premier Paws Pet Care, LLCharmless from claims, damages, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Portal, (b) inaccurate information you provide about your pet, or (c) your violation of these Terms.
13. Termination
You may stop using the Portal at any time. We may suspend or close your account if you violate these Terms, if we're required to by law, or if we discontinue the Portal. On termination, you may request a copy or deletion of your data per our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll post the updated version here with a new "Last updated" date and, when reasonable, notify you by email. Continued use of the Portal after changes take effect means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New Castle County, Delaware.
